In using this website you are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “Customer”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to Harley Academy. “Party” and “Parties” refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law.

Privacy Statement

We are committed to protecting your privacy. Authorised employees within the Company on a need to know basis only use any information collected from individual Clients. We constantly review our systems and data to ensure the best possible service to our Clients. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Confidentiality

We are registered under the Data Protection Act 1998 and as such, any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than professional bodies such as the General Medical Council if legally required to do so. Clients have the right to request sight of, and copies of any and all of their Client Records which we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Clients with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Disclaimer

Exclusions and Limitations

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and
  • excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

This Company does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Accreditation and Future Revalidation

Government ministers are currently in the process of debating whether to implement the HEE recommendations. The intention is for the recommendations to become an enforceable requirement by 2018. Regardless of the government’s position on the legality of training to these guidelines, it will always be considered best practice to be trained to the recommended standards. We have made every effort to ensure our graduates are trained according to the new requirements; however we can not be held responsible if:

  • The guidelines change;
  • There are further requirements for future qualification which are not met by Harley Academy’s training structure.

We will make every effort to inform our students on updates regarding the regulation status.

Assessment

Failure of the assessment component in Harley Academy will result in having to re-take the examination. This will incur a cost of £200.

Payment

We accept debit cards, direct debit payments and all major credit cards via PayPal as acceptable methods of payment. Payment can be made by a single payment, five instalments or ten instalments. Payment must be made in full on the due date. Monies that remain outstanding on the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid after the due date. In such circumstances, you shall be liable for any and all additional administrative and/or court costs. *In the event that any monthly instalment plan is terminated, you will still be responsible for any outstanding balances due*.

Registration Check

We reserve the right to decline your application if the Client fails their professional registration check. The Client will be entitled to a full refund minus a £35 administration fee.

Code of Conduct

We reserve the right to cancel further training if a Client fails to abide by the Code of Conduct as issued upon booking of the training course.

Clients must be fluent in English to attend the practical placement and assessment.

Termination of Agreements and Refunds Policy

Harley Academy has the right to terminate any Services Agreement for any reason. In such case, no refunds shall be offered where a Service is underway but any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded. The Client does not have the right to terminate any Services Agreement. Once a Client has entered into a Services Agreement, no refunds are payable by Harley Academy.

Availability

Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best of our ability. By using this service you thereby agree to indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Log Files

We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Like most interactive web sites this Company’s website or ISP uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control (together “Force Majeure”), which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of these Terms and Conditions or any Agreement or the failure of either Party to exercise any right or remedy to which they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under these Terms and Conditions or any Agreement. No waiver of any of the provisions of these Terms and Conditions or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

The laws of England and Wales govern these terms and conditions. By accessing this website and using our services you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the website will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our website 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

 

Practical Training Terms & Conditions

Bookings

Right of access to all training courses provided by Harley Academy is given to the person whose details were entered when booking with us. When booking for others, their details must be entered at the registration stage. You accept responsibility for all activities that occur under a booking in your name.

Intellectual property rights

Some of the content, layout, design, data, and information on our training materials is protected by UK and other international copyright laws. You agree not to adapt, alter or create any derivative work from any of the material contained in the materials or to use the material for any purpose other than your personal, non-commercial use.

None of the content of Harley Academy materials and hand-outs may be copied or otherwise incorporated into or saved in any other website, electronic retrieval system, publication, or any other work in any form (whether hard copy, electronic, or other). For the avoidance of doubt, framing of these materials or any part of them is not permitted without our express written permission.

Permission for use of our intellectual property

Any requests for permission to use our images or other use of our intellectual property not authorised by these Terms and Conditions should be made to enquiries@harleyacademy.com

Trademarks

The trademarks and logos which are displayed on our learning materials are the trademarks of Harley Academy or its partners. Any use of Harley Academy trademarks or other trademarks displayed on our learning materials is strictly prohibited without our express written consent.

Personal data and privacy

Use of the data you provide to us or which is collected by use of our booking systems, is governed by our Privacy Policy.

Losses

To the fullest extent permitted by law, we will not be liable for any direct or indirect or consequential losses (including loss of profit, revenue, anticipated savings or wasted expenditure) other than when your booking cannot be fulfilled, following conclusion of a binding contract and in which case Harley Academy shall be liable only for the fees paid for the booking.

Events Beyond Our Reasonable Control

To the fullest extent permitted by law we will not be held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any cause which is beyond our reasonable control including reasons of Force Majeure. This provision does not affect your statutory rights.

Alteration of Service or Amendments to Conditions

We reserve the right to make changes to our learning materials, policies and terms and conditions at any time. You shall be subject to the policy’s terms and conditions in force from the time you make a booking. If any of these conditions are deemed invalid, void or unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any other condition.

Disclaimer

Our learning materials, and all information contained on them, are provided on an “as is” basis and are intended for medical professionals. It is provided without warranty of any kind, express or implied.

We rely on both academic and industry sources to confirm the accuracy of the information presented and therefore we as the presenters cannot guarantee its accuracy. Cancellations & Refunds

(a) Booking Cancellation by Harley Academy

Harley Academy reserves the right to cancel an event due to low enrollment or other circumstances which would make the event non-viable.

If Harley Academy cancels an event, registrants will be offered a full refund.

Should circumstances arise that result in the postponement of an event, Harley Academy has the right either to issue a full refund or transfer registration to the same event at a new, future date.

(b) Booking Cancellation by Participant

Unless specifically stated on booking materials, the deadline to receive a full refund for your booking is 40 business days before the first or only day of training.

Registration cancellations received prior to the deadline may be eligible to receive full refund less a £25 service fee.

Cancellations received after the stated deadline but before 20 business days prior to the training event will be eligible for a 50% refund.

Cancellations received within 20 business days of the training event but over 10 business days prior to the event will be eligible for a 25% refund.

Registration cancellations received within 10 days of the training event will not be eligible for a refund.

Refunds will not be available for registrants who choose not to attend an event.

Cancellations will be accepted in writing only to enquiries@harleyacademy.com and must be received by the stated cancellation deadlines. All refund requests must be made by the attendee or credit card holder. Refund requests must include the name of the attendee and/or transaction number. Refunds will be credited back to the original credit card used for payment.

These above policies apply to all Harley Academy training events unless otherwise noted in the corresponding event materials. Please read all individual event information thoroughly.

Governing Law and Jurisdiction

To the fullest extent permitted by law, these conditions shall be governed by and construed in accordance with the laws of England and Wales. You agree, as do we do, to submit to the exclusive jurisdiction of the English Courts, save where it is necessary for enforcement proceedings to bring proceedings against you outside of England.

When you enter these details which are registered with us, your right of access is personal to you, for as long as we choose to allow such access. Personal accounts may not be shared, and you are responsible for preventing unauthorised access to your account. Termination

Harley Academy may terminate your access to all or any part of the website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Harley Academy e-Learning account (if you have one), you may simply discontinue using the website. Notwithstanding the foregoing, Harley Academy can terminate your Account if you materially breach the Terms & Conditions and fail to resolve the breach within 30 days from Harley Academy’s notice to you thereof; provided that, Harley Academy can terminate the website immediately as part of a general shut down of services.

Refunds

Our refund policy complies with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 which relate to distance selling.

In accordance with the above law there is a 14-day cooling off period during which time you have the right to cancel your purchase. If you decide to cancel, we will refund your payment within 30 days of your cancellation.

Because of the nature of our products it is not our policy to refund for e-Learning courses once access has been made via the unique access codes. All access to our systems is governed by a unique username and password. The username and password is part of a system that protects the security of the resource and enables us to monitor usage by any individual. When a refund request is received we reserve the right to track the usage by an individual (through his/her username and password). No refund will be granted if Harley Academy has reason to believe that an individual has viewed any of the course material that they purchased.

Governing Law and Jurisdiction

To the fullest extent permitted by law, these conditions shall be governed by and construed in accordance with the laws of England and Wales.
